Mainstay and Mainstaycomm.net, Privacy Statement

Updated November, 2015

Mainstay and Mainstaycomm.net (collectively, "Mainstay" or "Mainstaycomm.net") are concerned about customer privacy and is committed to protecting the privacy of our Internet access customers and visitors to our website, Mainstaycomm.net. Mainstay limits the information we collect regarding our customers and visitors to what is reasonably needed to conduct business and to offer products and services that might be of interest to you. You may choose to provide individually identifiable information (such as your name, address, telephone number or e-mail address) to Mainstay in a number of ways through our web site - by ordering a service, sending an e-mail, or registering to receive news or public information. This policy summarizes the main ways we use and do not use your personal information.

Mainstay has no obligation to monitor your use of the Service we provide to you. However, you agree that Mainstay has the right to monitor the Service electronically from time to time to operate the Service properly or to protect itself or its subscribers, and to disclose any information as necessary to satisfy any law, regulation or other governmental request. Mainstay will not intentionally monitor or disclose any private electronic mail message unless required by law.

Mainstay does not:
Collect individually identifiable information from our customers or visitors via our website unless it is provided to Mainstay. (Mainstay does ask for individual information for account set up.)
Sell your browsing history or use it for any purposes other than reasonable network management or to comply with governmental laws, regulations, or orders.
Sell the names and addresses of visitors to Mainstaycomm.net's website to unaffiliated suppliers, without providing information on that disclosure to the visitor at the time of the request for the individually identifiable information.

Mainstay does:
Use security techniques designed to protect customers' information from unauthorized access. (See Information Security below.)
Honor customers' requests to remove their names from our telephone or mail solicitation lists using reasonable efforts to delete the information from existing files. (You may contact Mainstay to request such removal.)
Monitor customer use of our Services from time-to-time for network management purposes.  More information can be found below and in our network management policy on our website.
In addition to individually identifiable information, Mainstay may collect information automatically when a visitor enters the Mainstay website, such as the domain name, browser, the type of computer operating system, information about the web page from which the visitor linked to the site, and time spent on different pages within the site. Mainstay may use this information to operate, evaluate, and improve the site. You should be aware that because of the nature of the Internet, your use of the our website or our Services may require us to provide information of our customers or collected from customers or visitors, automatically or otherwise, to third parties, including affiliated parties who help us provide or maintain our services, as well as third parties who are unaffiliated with us, but who are connected with our networks or the websites customers may visit when using our Services.

Network Management
For purposes of reasonable network management, including protecting our network and other customers, Mainstay may collect equipment information to identify the equipment you are using on the network, including, but not limited to: equipment type, serial number, settings, configuration and software. Mainstay may also collect performance information to examine the operation of the equipment, services and applications the customer may use on the network, including, but not limited to: IP addresses, URLs, data transmission rates and latencies, location information, security characteristics, and information about the amount of bandwidth and other network resources customer is using in connections with uploading, downloading or streaming data to and from the Internet.

Cookies
A cookie is a small, encrypted data string the Mainstaycomm.net server and your web browser software writes to your hard drive. A cookie, which may be supplied by Mainstaycomm.net or unaffiliated websites that you visit, contains your unique Mainstaycomm.net User ID and other information that websites use to track your browsing or improve your experience on their website. Cookies are used to deliver web content specific to your interests and to control access to your personal shopping cart after your initial entry. The cookie permits the server to recall information from your previous visit. A cookie is not used to access or otherwise compromise the data on your hard drive. With most browsers, you can choose to change your browser settings to disable or delete cookies. Please be aware that cookies may be required to complete certain functions on the Mainstaycomm.net website and other Internet sites.

Information Security
Mainstay has security measures in place to protect against the loss, misuse and alteration of information under Mainstay's control. When you place an order, the information you submit is encrypted using the Secure Sockets Layer (SSL) protocol.

Disclosure of Account Information
As a general rule, Mainstay does not release customer account information to unaffiliated third parties except as necessary to operate, provide, or maintain our Services, where the disclosure is appropriate. There are exceptions to this general rule. For example, Mainstay might provide information to regulatory or administrative agencies so that they can accomplish their regulatory tasks (for example, responding to a customer complaint) or to maximize the efficiencies of our own processes (such as correcting mailing addresses). Other disclosures will be driven by legal requirements imposed on us. Mainstay complies with "legal process," such as a subpoena or court order or other similar demand, associated with either criminal or civil proceedings.
Mainstay may provide account information to collection agencies when customers do not pay their bills. Use that can be made of this information is limited to collection activities for our charges and for the charges Mainstay bills for others.
We will comply with Federal Communications Commission ("FCC") rules that govern our use of your account and other personal information in connection with any broadband Internet access Service you receive from us.

Value Added
Because Mainstay appreciates the trust you have placed in us, we continually look for ways to enhance our business relationship. From time to time, Mainstay may inform you about a product or service. Using the information you have provided, Mainstay strives to limit our offers to those we think you would appreciate receiving. Mainstay wants every contact you have with us to be a positive experience. So if you would prefer not to receive these value-added services, offers and opportunities, just contact us.

Children
Children should consult with their parents or guardian before furnishing any data to Mainstay. Mainstay believes that parents should supervise their child's on-line activities and recommends that parents consider using one of a number of available parental control tools that provide a child-friendly on-line environment and can prevent children from disclosing individually identifiable or personal information without parental consent. Because the Internet offers open access to a wide range of information, it is important that parents supervise and prevent access to inappropriate content, email or chat sessions.

Links
Mainstay is not responsible for content or privacy policies of other websites. You should keep this in mind when accessing sites through links on Mainstay's website.

Updates
Mainstay will constantly strive to improve the services offered, and may update this privacy statement from time to time in connection with that effort. Mainstay reserves the right to expand our capabilities for information collection and use, and may change our policies along with this privacy statement at any time.
